Passport is an official document issued to the general public by the Ministry of External Affairs, MEA. Passport is a mandatory document required to travel abroad. Passport can be used as a document for Identity Proof, Age Proof and Address Proof.

As per the Emigration Act passed by the Government of India in 1983, ‘emigration’ is defined as the act of leaving the home country, in order to settle abroad on the basis of getting employment. As per the Emigration Act, citizens holding certain category of Indian Passports must obtain ‘emigration clearance’, without which they cannot emigrate to certain countries.

Indian Passports are divided into two categories:

1) ECR Passports: ECR stands for Emigration Check Required, and these passports are issued to those citizens whose educational qualification is less than matriculation. These individuals need Emigration Check when they want to immigrate to certain countries on the basis of getting an employment opportunity. Their emigration is subject to clearance from the Indian Government.

This is done to ensure ECR passport holders’ job security and also preserve their human rights. ECR passport holders require clearance from the office of the Protector of Emigrants (POE),  for emigration to the following countries; United Arab Emirates (UAE), Kingdom of Saudi Arabia (KSA), Qatar, Oman, Kuwait, Bahrain, Malaysia, Libya, Jordan, Yemen, Sudan, Brunei, Afghanistan, Indonesia, Syria, Lebanon, Thailand, and Iraq.

2) ECNR Passports: ECNR stands for Emigration Check Not Required, and these passports are issued to those citizens who are matriculates. ECNR passport holders don’t require clearance from the office of the Protector of Emigrants (POE) for emigration to any country.

People who don't Require Emigration Check

These individuals are exempted from emigration check:

  • Diplomatic passport holders
  • Gazetted officers
  • Income Tax payers
  • Professionals like engineers and doctors
  • Permanent Residence visa holders of USA, UK and Australia
  •  Individuals who have resided overseas with their spouse for more than 3 years
  • Individuals whose educational qualification is matriculation and above
  • Individuals who are more than 50 years of age
  • Individuals less than 18 years old living with single or both parents.

Documents Required for ECNR in Passport

Non-Emigration Check Required category

Diplomatic passport holders

1. For Gazetted Government employees:

-Identity Certificate as per Annexure A or NOC as per Annexure M

For children of Gazetted Government employees

-Identity Certificate as per Annexure B, or

-Birth certificate that has been issued by the Municipal authorities or any other authority that has the authority t-issue death and birth certificates, or

-Certificate of school leaving /Certificate of secondary school leaving/Certificate of last attended institution, or

-Copy of thepassport of the government employee

2. For spouses of the Gazetted Government employees:

-Identity Certificate as per Annexure B, or

-Joint Affidavit as per Annexure D, or

-Photocopy of marriage certificate, should be notarized

Matriculation or class XII or UG/PG degree certificate

Individuals of the age of 50 years and above

-Birth certificate

-Certificate of school leaving / Certificate of secondary school leaving / Certificate of last attended institution, or

-Affidavit that is sworn in front of the Notary / Magistrate stating place and date of birth as per Annexure A by semi illiterate or illiterate applicants

Children up tp 18 years of age. In case of re-issue of passport, after they reach the age of 18 years, documents for proving their ECNR category must be submitted, or else ECR will be stamped

Certificate of school leaving / Certificate of secondary school leaving / Certificate of last attended institution

Income Tax Payers, their dependent below 18 years of age: children and spouses

1. For income tax payers:

-Assessment proof of income tax and actual income tax payment for the previous assessment year

-ITR for the previous assessment stamped by the IT authorities and a photocopy of the PAN card. Applicants wh-submit nil ITR are not eligible

-Birth certificate or

-Certificate of school leaving / Certificate of secondary school leaving / Certificate of last attended institution

Professional degree holders, their dependent children and their spouses.

1. Certificate of professional degree

2. For spouses of professional degree holders:

-Photocopy of marriage certificate (attested, or Joint Affidavit as per Annexure D

 

3. For dependent children of the professional degree holders:

-Birth certificate or

-Certificate of school leaving / Certificate of secondary school leaving / Certificate of last attended institution

All individuals wh-have stayed overseas for a span of three years or more along with their spouses. The three years can be in parts or in one stretch

1. Photocopy of the passport (last tw-pages and first tw-pages) including the page with ECR / ECNR

2. For the spouses:

-Photocopy of marriage certificate (attested) issued by the Registrar. Spouse's name must be endorsed in the passport application for verification, or

-Joint Affidavit according t-Annexure D

3. Applicant must submit a statement with all the details of entry and exit dates along with the passport for verification

Seamen wh-have their CDC (Continuous Discharge Certificate), Deck Cadets and Sea Cadets

1. Individuals wh-have passed B.Sc. Nautical Science (3 years course) at T.S. Chanakya, Mumbai

2. Individuals wh-have undergone pre-sea training for three months at training institutes approved by the Government like T.S. Rehman, T.S. Chanakya, MTI, NIPM and T.S. Jawahar, Chennai

Continuous Discharge Certificate

People with permanent immigration visa. Example “ Visas for Australia, the UK and the US

Photocopy of the immigration visa or Permanent Resident card of nation in which the individual stays at present

How to Check Passport ECR or ECNR?

For the passports that were issued before January 2007, if you don’t find any endorsement or notation on the second page of the passport, then it means that the passport is issued on ECR basis. These passport holders have to undergo emigration clearance and obtain clearance certificate from the office of the Protector of Emigrants (POE). Failing to get clearance would mean that they would not be allowed to emigrate to those countries mentioned earlier.

How To Check ECNR Status?

For all the passports that were issued after January 2007, if you don’t you find any endorsement or notation on the second page of the passport, then it means that the passport is issued on ECNR basis. These passport holders are already cleared for emigration to any country, including those mentioned earlier. ECR seal would be stamped on the passport for failing to produce the required documents for ECNR.

ECR Stamp on Passport

The Ministry of External Affairs would stamp the ECR seal on your passport, if you fail to produce the required documents to obtain ECNR status passport. Having a passport with ECR status makes it difficult to travel abroad. You must receive clearance from the office of the Protector of Emigrants (POE) to emigrate to the countries mentioned earlier. It is advisable to obtain passport on ECNR basis to enable hassle-free emigration.

Suspension Of ECR Status:

A one-time ECR suspension can be availed, at all international airports across the country, to travel to the countries mentioned earlier for a reason other than employment. ECR Suspension is subject to furnishing the below mentioned documents:

  • Filled ECR suspension application form along with a fee of Rs 400.
  • Original passport along with one attested photocopy.
  • Attested photocopy of your visa.
  • Attested photocopy of the confirmed return tickets.
  • Your current address proof.
  • For traveling to GULF countries, you need to produce sponsorship declaration attested by the Indian Consulate.

ECR suspension is provided for the below mentioned reasons:

  • Sudden death of a relative staying abroad.
  • ECR passport holder who must travel abroad for accidental injury to self and relatives.
  • To represent the country at International level sports, requires approval from the Ministry of Youth Affairs and Sports.
  • VIPs and the accompanying family members.

Procedure To Remove ECR Stamp From Passport:

  • Download the application form by logging on to http://www.cgihk.gov.in/pdf/EAP2.pdf
  • Fill the application form by mentioning the ECR deletion request.
  • Attach the attested photocopies of the documents required to obtain ECNR status.
  • Attach a document each for Identity Proof, Age Proof and Address Proof.
  • ECNR update to the existing ECR passport holders is provided at a fee of Rs 300.
  • Visit the nearest passport office for document verification.
  • You must surrender your current ECR passport, along with the attested copies of the documents mentioned above. You also need to produce attested photocopy of the current passport.
  • ECNR passport would be granted, subject to furnishing of the required documents.
