What is a consumer complaint?

A consumer complaint is an expression of dissatisfaction by the consumer to the party responsible. A consumer complaint is a written complaint regarding any person or company for offering poor quality goods or low grade services.

How to lodge consumer complaint online?

An individual can file a complaint online by visiting the government portal of complaint and grievance re-addressal known as consumer online resource and empowerment centre. The steps to file an online complaint are mentioned below:

  • Visit the website and register by clicking on the ‘new user’.
  • Provide the required details like name, e-mail, address, phone number.
  • After registering, go to ‘log in’ and provide the user name and the password
  • Go to ‘file complaint’ and file the complaint
  • Select the complaint type
  • A page containing the registration form will open.
  • You have to fill the form with necessary details of the problem or the grievances
  •  click ‘submit’ to make a submission

As per the website, you are expected to get a resolution in 3 months and can also check the status of your complaint by logging on to the website.

How to file complaint in consumer court?

A consumer can file a complaint in the consumer court at the district consumer forum for goods or services valued up to Rs 20 lakhs and at the state commission up to Rs 1 crore and at the national commission for Rs 1 crore or above. The complaint can be filed by consumers in case he/she feels the services or the goods provided are defective, low in quality, or services are deficient and do not respect consumer rights. Consumers can file a complaint, appeal or petition under the consumer protection act and the court asks for a nominal fee.

The procedure for filing a complaint before the district forum:

There is a time limit for filing a complaint in the consumer forum. The complaint must be filed within 2 years of the cause of action. Below are the steps to file a consumer complaint.

  • Identify the jurisdiction of the form where the complaint is filed.
  • File a complaint (handwritten or typed) and pay the prescribed fee along with the complaint.
  • Mention the name, description and address of the complainant and the name, description, address of the opposite party or parties against whom relief is claimed.
  • Attach copies of documents supporting your complaint.
  • You can ask for compensation. The cost should be specifically mentioned along with the complaint.
  • Complaint must clearly state as to what relief is sought against the opposite party.
  •  File an affidavit along with the complaint that states the facts in the complaint are true and correct.
  • You also need to submit one original and two photocopies of the complaint to the consumer forum. You must submit as many more copies as there are parties.
  • You are also asked to send a notice in writing to the supplier or service provider you are complaining against, clearly pointing out the grievances.
  • You are also required to give ample time to the respondents to either address the issue you have raised or come prepared to the consumer forum. Make sure that the notice you sent reaches the respondents/defendants and for that, send it to the address where they are available.
