PepsiCo takes back all cases against Gujarat farmers

PepsiCo India "unconditionally" withdrew all its cases against potato farmers of Gujarat for alleged infringement of rights over a particular variety of the tuber. The farmers involved said they have sought a token Rs.1 compensation from the Indian-arm of the US food and beverages giant PepsiCo for defamation and for being falsely dragged into a case alleging illegal use of a registered potato variety.

PepsiCo Inc said it will withdraw its lawsuits against a number of potato farmers accused of infringing its patent. After suing four farmers for cultivating the FC5 potato variety, grown exclusively for PepsiCo's popular Lay's potato chips, the snack food and drinks maker said last-week it wanted to "amicably settle" the issue. Ahmed Patel Says PepsiCo's Decision To Sue Farmers "Brazenly Wrong"

Terming as "brazenly wrong" PepsiCo's legal action against Gujarat farmers for growing-a-variety of potatoes "registered" by company, senior-Congress-leader Ahmed Patel said corporate interests cannot dictate what farmers must or must not cultivate. He also said that the state government should not keep its eyes "shut" to the development. The Congress leader was referring to the Protection of Plant Variety and Farmers Right Act, 2001.
